These Terms & Conditions apply to the use of kcmoveacademy.com and to the online educational content, course information, student portal access, digital materials, forms, payments and related services offered through the website by Kineticode B.V., trading as K/C Move Academy and KinetiCode® Academy.
By using this website, creating an account, purchasing a course, accessing course materials or submitting a form through the website, you agree to these Terms & Conditions.
1. Company details
Kineticode B.V. is a private limited liability company incorporated under the laws of the Netherlands, having its corporate seat in Amsterdam and its office at Rozengracht 93A, 1016 LT Amsterdam, the Netherlands.
Kineticode B.V. is registered with the Dutch Chamber of Commerce under number 70370079.
In these Terms & Conditions, Kineticode B.V. is referred to as “K/C Move Academy”, “KinetiCode® Academy”, “we”, “us” or “our”.

2. Website use
The website kcmoveacademy.com provides information about K/C Move Academy, KinetiCode® educational programs, online courses, teacher training, certification programs, workshops, course materials and related services.
You may use the website only for lawful purposes and in a way that does not damage, disable, overload or interfere with the website, our systems or other users.
You may not use the website to upload, transmit or distribute viruses, malicious code, spam, unlawful content or content that infringes the rights of others.
We may suspend or restrict access to the website, student portal or related services if we reasonably believe that these Terms & Conditions have been breached.
3. Course information
We aim to keep all information on the website accurate and up to date. However, course dates, prices, teachers, content, schedules, formats, availability and other details may change from time to time.
The information on the website is provided for general information and enrolment purposes. The final details of a specific course, certification program, payment plan or workshop may also be confirmed in course-specific information, the student handbook, enrolment forms, email communication or the student portal.
If there is a conflict between these general website Terms & Conditions and specific written course conditions, the specific course conditions apply first for that course.
4. Accounts and student portal access
To purchase a course, access digital materials or participate in certain services, you may need to create an account or receive access to the student portal.
You are responsible for providing accurate and complete information and for keeping your login details confidential.
Account access is personal and non-transferable. You may not share your login details, course access, recordings, downloads or student portal content with another person.
We may suspend or terminate access if an account is misused, shared with others, used unlawfully, connected to non-payment, or used in a way that infringes our intellectual property rights.
5. Purchases, payments and enrolment
Prices for courses, workshops, certification programs and other products are published on the website or communicated in writing.
All prices include VAT where applicable, unless expressly stated otherwise.
Payment must be made before access to the relevant product or service is granted, unless a payment plan or other written arrangement has been agreed.
Payments may be processed through third-party payment providers or platforms. K/C Move Academy does not store full payment card details.
If a payment plan is agreed, the student remains responsible for paying the full agreed amount according to the agreed schedule. Access to course materials, exams or certification may be suspended if payments are overdue.
Promotions, discounts and special offers are valid only under the stated conditions and during the stated period. They cannot be applied retroactively.
6. Digital content and course access
Courses and digital materials may include videos, live session recordings, PDFs, manuals, handbooks, lectures, assignments, quizzes, exams, exercise libraries and other online educational content.
Course access is granted for the access period stated at purchase, in the course information or in the student portal. Unless expressly stated otherwise, access is temporary and may expire after the course period or another stated access period.
We aim to provide reliable access to the website and student portal, but we do not guarantee uninterrupted access. Access may be temporarily unavailable due to maintenance, updates, technical issues, third-party platform issues or circumstances outside our control.
You are responsible for having a suitable device, internet connection, browser and technical setup required to access online materials and live sessions.
7. Right of withdrawal
For purchases made online or at a distance, consumers may have a statutory right to withdraw from the agreement within 14 days without giving a reason.
The withdrawal period starts on the day after the agreement is concluded.
To exercise the right of withdrawal, you must contact us at academy@kcmove.nl with a clear statement that you wish to withdraw from the purchase, including your name and purchase details.
If you ask or agree that the service starts during the withdrawal period, and you use the service during that period, we may charge a reasonable amount for the service already provided.
Where a product includes digital content, including videos, recordings, PDFs, manuals, downloads, student portal access or other digital course materials, you may lose the right of withdrawal once access to the digital content has started with your prior express consent and acknowledgement that the right of withdrawal is lost.
This article does not limit any mandatory consumer rights.
8. Cancellations, transfers and refunds
All cancellation, transfer or refund requests must be submitted in writing to academy@kcmove.nl.
Failure to attend or complete a course does not automatically entitle you to a refund.
Non-use of course materials, missed live sessions, missed deadlines, technical issues on your side or lack of time to complete a course do not automatically entitle you to a refund.
Where a refund is approved, it will be processed within 30 days of approval, unless a shorter period is required by law.
We may allow a transfer to another course date, cohort or product at our discretion. Transfers may be subject to availability, administrative conditions and additional costs.
9. Course changes, postponement and cancellation
We aim to deliver courses, live sessions, exams and workshops as scheduled. However, we may change teachers, dates, times, locations, content order, platform, format or delivery method where reasonably necessary.
We may postpone or cancel a course, live session, exam or workshop in case of insufficient enrolment, teacher illness, technical issues, operational reasons, force majeure or other circumstances outside our reasonable control.
If we cancel a course, we will offer a suitable alternative, transfer, credit or refund where appropriate.
If we postpone a course and you are unable to attend on the new dates, we may offer a transfer to another course or a credit valid for one year, depending on the circumstances.
We are not liable for travel, accommodation, loss of income or other costs incurred in connection with a course change, postponement or cancellation, unless required by law.
10. Student responsibilities
Students are responsible for reading the relevant course information, meeting any applicable entry requirements, attending scheduled sessions, completing required self-study and submitting assignments or exams within the communicated deadlines.
Completion of a course or certification program does not guarantee employment, income, studio placement, teaching opportunities or professional registration, unless expressly agreed in writing.
Students are expected to act respectfully and professionally towards teachers, staff, other students and any persons involved in the course.
Discrimination, harassment, intimidation, unsafe conduct, unauthorised recording, misuse of course materials or behaviour that damages K/C Move Academy, K/C Move or KinetiCode® may result in suspension or termination of access.
11. Health and practical participation
Some courses may include physical practice, movement education, Pilates exercises, live practical sessions, mentor reviews or video submissions.
Participation in practical components is at the student’s own risk.
Students are responsible for assessing whether they are physically able to participate and must inform the teacher or trainer of any injury, illness, pregnancy, medical condition or other limitation that may affect safe participation.
K/C Move Academy services are not medical treatment and do not replace medical advice, diagnosis or care.
12. Intellectual property
All intellectual property rights relating to the K/C Move and KinetiCode® brands, methods, concepts, exercises, educational programs, course materials, videos, recordings, live sessions, PDFs, manuals, handbooks, graphics, images, website content, student portal content, trademarks, designs, logos and other materials belong to K/C Move, Inessence Holding B.V. or their licensors.
Course materials are provided solely for personal study and professional development during the authorised access period.
You may not copy, reproduce, distribute, share, lend, resell, publish, upload, teach, record, transmit, translate, adapt, modify, make available or otherwise use course materials or KinetiCode® content without prior written consent from K/C Move Academy.
You may not share login details, download links, videos, manuals, recordings, screenshots, lecture content, exam content or other course materials with non-students or third parties.
Any infringement may result in immediate termination of access, refusal of certification, liability for damages, legal fees and other remedies available under Dutch law.
Knowledge gained through a course may be applied for personal development or professional teaching within the scope of your qualification. This does not permit you to copy, reproduce, teach, distribute or commercialise actual course materials, KinetiCode® content or protected methods.
13. Recordings, photos and videos
We may record online lectures, live sessions or educational sessions for educational, administrative or internal purposes, where appropriate and in accordance with applicable privacy law.
Recordings may include a student’s name, voice, image, questions, comments or participation if the student actively participates in the recorded session.
Students must not record, screenshot, photograph or film courses, live sessions, exams, mentor reviews, teachers, trainers or other students without prior written consent.
We may use photos or videos for promotional purposes where permitted by law. Where required, we will ask for consent before using clearly identifiable promotional photos or videos.
14. Third-party platforms and links
The website, student portal and course materials may contain links to third-party websites, platforms or services, including payment providers, video platforms, learning platforms, scheduling tools, analytics tools or communication tools.
We are not responsible for the content, availability, security or privacy practices of third-party platforms.
Use of third-party platforms may be subject to their own terms and privacy policies.
15. Privacy
We process personal data in accordance with our Privacy Policy, published on the Academy Website.
16. Complaints
Complaints may be submitted in writing to academy@kcmove.nl.
The complaint should include your name, contact details, the relevant course or product, the date and a clear description of the complaint.
Where appropriate, students should first attempt to resolve practical questions or lesson-related concerns directly with the relevant teacher or K/C Move Academy contact person.
We will aim to respond within 14 days. If more time is required, we will inform you.
17. Liability
We shall provide our services with reasonable care and skill.
To the maximum extent permitted by law, we are not liable for injury, loss or damage resulting from participation in courses, practical sessions, exercises, use of facilities, failure to follow instructions, failure to disclose relevant health information, misuse of course materials, technical issues outside our control or circumstances outside our reasonable control.
Nothing in these Terms & Conditions excludes liability where such exclusion is not permitted by law, including liability for intent, gross negligence or mandatory consumer rights.
You are liable for damage caused to K/C Move Academy, its platforms, course materials, teachers, staff, other students or third parties if such damage results from negligence, misuse, breach of these Terms & Conditions or intentional conduct.
18. Force majeure
We are not liable for failure or delay in providing services caused by circumstances outside our reasonable control, including but not limited to government measures, public health restrictions, illness, fire, flooding, power failure, internet failure, platform failure, technical failure, strikes, transport disruption, natural events or other events of force majeure.
Where possible, we will offer reasonable alternatives, such as rescheduling, online delivery, recordings, transfer, credit or another appropriate solution, depending on the circumstances.
19. General provisions
Failure by K/C Move Academy to exercise any right does not constitute a waiver of that right.
If any provision of these Terms & Conditions is invalid or voided, the remaining provisions remain in force. The invalid provision shall be replaced by a valid provision that reflects the original intention as closely as possible.
20. Governing law and jurisdiction
These Terms & Conditions and any disputes arising under or relating to them shall be governed exclusively by Dutch law.
Any disputes shall be submitted to the competent court in Amsterdam, the Netherlands, unless mandatory consumer law provides otherwise.
